Matter of: BW JV1, LLC

A mistake in the spelling may have been "a mere matter of form," but it called into question the surety's liability. BW JV1, LLC (BW JV1) bid on a Department of Veterans Affairs (VA) project to renovate the Clement J.Zablocki VA Medical Center in Milwaukee, Wisconsin. The solicitation required bidders to submit a bid bond, which BW JV1 did. However, the VA rejected BW JV1's bid because it could not determine that the principal named on the bond was the same entity identified in the bid.

The bidder's name, address and signatories appeared differently on three documents. The bid named the bidder as "BW JV1" of New Berlin, Wisconsin and contained the [...]
