Contract Award Cancelled Prior To Signing Bids

The Arizona Supreme Court has ruled that a public school board could vote to accept a low bid and then cancel the award prior to formal contract execution. The Washington Elementary School District solicited bids for construction of new classrooms. Ry-Tan Construction, Inc. submitted the low bid. The project architect recommended that the contract be awarded to Ry-Tan.

The School District's governing board voted to accept Ry-Tan's bid. A meeting was scheduled for the next day when the parties were to execute the contract and Ry-Tan was to provide the necessary bonds. That evening, Ry-Tan mobilized equipment at the site and started [...]
