Contractor Responsible For Pre-bid Soil Investigation Differing Site Conditions-subsurface

An Ohio court has ruled that a project owner did not withhold information regarding groundwater at the site. And the contract documents made bidders responsible for conducting their own subsurface investigations.

The City of Troy was planning an extension of its sewer system. Much of the new line was to be installed under an existing roadway. The City's consulting engineer said shallow groundwater might be present in the area, but the City's agreement with the engineer expressly excluded the performance of any test borings.
