Proprietary Specification Enforced Plans And Specifications; Delay-compensable

The Armed Services Board of Contract Appeals has ruled that an express proprietary specification effectively barred the use of any substitute product, including an alleged "equal."

The Naval Facilities Engineering Command issued an invitation for bids for construction of a laboratory in Newport, Rhode Island. The work included an electrical substation to be linked to an existing substation which had been manufactured by the Square D Company.
