Contractor Sues Cm Over Master Schedule Schedule; Negligence

A federal district court has ruled that a trade contractor could maintain an action against a construction manager (CM) for failure to incorporate milestone dates into a master project schedule, but only if the CM had exerted "excessive control" over the contractor.

The Perrysburg Exempted Village School District retained Rudolph/Libbe, Inc. to serve as CM for the construction of a new high school building. Riverside Masonry, LLC was preparing to bid on the masonry work.
