Bidder Recovers Lost Profit From City Bids-protests; Profit

An Ohio court, in a case of first impression, has allowed a disappointed bidder to recover anticipated profit on the contract from a public project owner. The integrity of the competitive bidding process outweighed double payment by the taxpayers.

The City of Fairlawn issued an invitation for bids for a road construction contract. Cementech, Inc. submitted the low bid on the contract. The City rejected the bid and awarded the contract to another bidder.

Cementech petitioned, twice, to enjoin the award and performance of the contract. Both times the petition was denied. [...]
