Supplier Did Not Breach Technical Support Obligation Suppliers

A federal appeals court has ruled that a material supplier had no technical support obligation to a contractor during litigation with the project owner. Nor was the supplier liable for failing to preserve evidence generated during a site inspection.

The White County, Indiana, Bridge Commission awarded a contract to the J. S. Sweet Co., Inc. to repair the travel surface of a bridge.
