Addendum Acknowledged Despite Missing Signature Bids-responsiveness

The Mississippi Supreme Court has allowed a public project owner to accept a bid which omitted a signature acknowledging an addendum which altered the definition of the work. The Court said the bid schedule itself indicated assent to the changes.

The Mississippi Transportation Commission solicited bids for construction of a new interchange on Interstate 55. The bid package included two unnumbered pages for the bidder to sign stating that the bidder would execute the contract if tendered.
