Change Order Work Was Unit Priced Unit Prices; Acceptance

A federal appeals court has ruled that extra work was ordered on a unit-price, not fixed-price, basis. And the government was entitled to revoke final acceptance in order to recover an overpayment from the contractor.

The U.S. Army awarded a fixed-price contract to Bender GmbH to clean and close a sewage treatment plant in Babenhausen, Germany. The scope of work included the removal and disposal of water and sludge in several tanks at the facility.
