Mechanic's Lien On Condos Had To Be Apportioned Liens

The Colorado Supreme Court has ruled that a blanket mechanic's lien could attach to fewer than all of the benefiting properties, but the total value of improvements had to be apportioned among all benefiting properties.

Anthem Communities awarded a contract to The Brickman Group, Ltd. for construction of 48 condominium units and common areas. Anthem failed to make full payment and Brickman filed a mechanic's lien on nine of the units, although 21 units remained unsold at that time.
