Purchase Order Did Not Govern Transaction Suppliers; Schedule

A federal appeals court has ruled that a contractor's purchase order and its delivery schedule did not govern a transaction with a material supplier.

Crossley Construction Corp. was the general contractor on a commercial construction project in Gatlinburg, Tennessee. Crossley's original metal roofing supplier was unable to provide sufficient materials in time for Crossley to meet its completion deadline. Crossley contacted NCI Building Systems, a metal fabricator and supplier located in Houston.
