Contractor Pursues Architect For Misrepresentation Architects And Engineers; Negligence

The Pennsylvania Supreme Court has allowed a contractor, for the first time in that state, to pursue an action against an architect for negligent misrepresentation.

The East Penn School District retained The Architectural Studio (TAS) to design a new school building in Lower Macungie Township. The drawings and specifications prepared by TAS were incorporated into the contract documents. Bilt-Rite Contractors, Inc. submitted the low bid and was awarded the construction contract.
