Lack Of Site Inspection Not Fatal To Spec Claim Inspection-pre-bid; Plans And Specifications

The U.S. Court of Federal Claims has ruled that while a contractor's failure to conduct a pre-bid site inspection defeated a differing site condition claim, it was not necessarily fatal to a claim for defective specifications.

The Navy solicited bids for electrical improvements at Point Mugu Naval Air Weapons Station in California. The contract documents included standard "Site Investigation" and "Differing Site Conditions" clauses. The Navy scheduled a site visit prior to bid submittal.
