Prompt Payment Act Applied Only To Progress Payments Payment; Attorney Fees

A Missouri court has ruled that the state prompt payment act applied only to contracts with scheduled progress payments. A subcontract calling for a single lump-sum payment was not covered.

Obermiller Construction Services, Inc was the general contractor for construction of two Wal-Mart stores in Fort Scott and Topeka, Kansas. Obermiller subcontracted the sealing of the two parking lots to Vance Brothers, Inc. for a fixed-price of $39,467 to be paid upon completion of the work. The subcontract was governed by the law of the state of Missouri.
