Bid Nonresponsive Due To Inadequate Subcontracting Efforts Bids-responsiveness; Subcontractors

A Pennsylvania court has ruled a bid nonresponsive because the bidder did not make adequate efforts regarding solicitation and participation of minority business enterprise and women business enterprise (MBE/WBE) subcontractors.

The Pennsylvania Department of General Services issued an invitation for bids for construction of a welcome center in Erie. The IFB required, in accordance with an Executive Order, that bidders solicit quotations from a minimum number of certified MBE/WBE subcontractors and suppliers.
