Sub Could Be Held To Quote Despite Known Mistake Bids-mistakes; Equitable Relief

A California court has ruled that a prime contractor could hold a listed subcontractor to its quoted price even though the sub informed the prime of a mistake before execution of a contract with a public project owner.

The City of Livermore solicited bids for renovation of its city hall. Diede Construction, Inc. was preparing to bid on the contract and received a price quotation for the mechanical work from Monterey Mechanical Co. Diede incorporated that price into its estimate, listed Monterey as its mechanical subcontractor, and submitted the low bid.
