A subcontractor's foolhardy attempt to catch up on incomplete work cost an equipment supplier its chance to collect on a lien.

Argo Construction Company, Inc. (Argo) supplied subcontractor Tower Construction, LLC (Tower) with equipment to perform excavation work on a project to construct a Kroger store in Ohio. When Tower defaulted on the lease agreement and failed to pay Argo, Argo filed a mechanic's lien against the project for $96,000.
