Proper and timely service cannot substitute for proper and timely filing for the purpose of starting an appeal from an 8(a) Business Development termination, according to the Small Business Administration Office of Hearings and Appeals (OHA).

An associate administrator for the 8(a) Business Development (AA/8(a) BD) program within the Small Business Administration terminated Commercial Roofing of Delaware, Inc. from the 8(a) program. Commercial Roofing appealed to the OHA on Jan. 22, 2007.
