Cost Overruns In Excess Of Retainage Leave Subcontractor Empty-handed

An Indiana appeals court rejected a subcontractor's argument that retainage the State held did not belong to the State but to the general contractor.

The State of Indiana (State) hired Voils Construction to make improvements to the visitor center at Mounds State Park in Anderson, IN. Voils subcontracted the tile and carpet work to CCI. Between October 2001 and May 2002, CCI submitted four payment requests to Voils totaling $35,450. Voils paid CCI a total of $15,000.
