Subcontract's Broad 'flow Down' Provisions Included Venue

A federal district court has ruled that a subcontract incorporating agreements the owner and contractor entered bound the sub to their venue selection.

General contractor Walton Construction Co. subcontracted drywall work on a construction project at the University of Missouri to Dynamic Drywall, Inc. The subcontract consisted of the subcontract itself and the prime contract between the owner and contractor "and other contract documents enumerated therein."

Additionally, the subcontract stated that "Contractor shall have the benefit of all rights, remedies and redress agai [...]
