A federal appeals court has ruled that it was permis-sible to consider a contractor's cost-savings plans when determining whether the contractor had actually relied on allegedly defective drawings.

The Jacksonville Transportation Authority awarded a contract to Martin K. Eby Construction Co., Inc. for a highway project which included a bridge across a creek and a second bridge across the Intracoastal Waterway in Jacksonville, Florida.
