Contractor Prevails With Acceleration Schedule; Acceleration

A contractor has lost its claim for owner interfer-ence with planned early completion, while proving enti-tlement to owner acceleration of the work in the final stages of the project.

The Army Corps of Engineers issued a request for proposals on behalf of the U.S. Army Morale, Welfare and Recreation Fund, a nonappropriated fund instrumen-tality (NAFI). The solicitation called for design and con-struction of a revenue-producing outdoor water park to be located at the Picatinny Arsenal in New Jersey.

After evaluation of competitive proposals, the NAFI awarded the design/build contract to Imperial Construction & Electric, Inc. The contract schedule al-lowed 55 days for preparation and review of a 50 percent design, another 55 days for preparation and review of 100 percent design, and 300 days for construction.
