Proposal Process Struck Down In Pennsylvania Bids

A Pennsylvania court has ruled that the state ver-sion of the ABA Model Procurement Code, authorizing the award of contracts based upon requests for proposals, does not apply to construction contracts. Competitive bidding is still required.

The Pennsylvania legislature adopted, in 1998, a modified version of the American Bar Association's "Model Procurement Code."
