No Remedy For Lost Proposal Bids

The Comptroller General has ruled that when an agency completely loses, as opposed to temporarily misplaces, a proposal, the offeror is left without a remedy.

The Army Corps of Engineers issued a request for proposals for environmental remediation services. Proposals were due at the office of the Sacramento District Corps of Engineers no later than 2:00 p.m. on October 12, 2005.

Project Resources, Inc. (PRI) shipped a proposal via FedEx. The FedEx tracking slip showed that the package was received at the proper office at 9:38 a.m. on October 12. But apparently the agency lost the proposa [...]
