Contractors Keep Refunded Permit Fees Equitable Relief

The Pennsylvania Supreme Court has ruled that contractors would not be unjustly enriched by pocketing refunded building permit fees they had carried in their fixed-price bids.

The Wilson Area School District awarded several prime contracts associated with the construction of a new high school building. The general conditions of the contracts included standard language requiring the contractor to obtain and pay for all permits and licenses necessary for the proper execution of the work.
