Endorsement Of Check Barred Further Claims Payment-final; Waiver

The Michigan Supreme Court has ruled that a check served as final payment and barred any further claims even though the contractor had crossed out the words "final payment."

Hoerstman General Contracting, Inc. remodeled a lakeside residence in Edwardsburg, Michigan. The scope of work expanded greatly during construction and there was a dispute regarding the balance due the contractor. Hoerstman claimed it was owed $32,750, but offered to settle the matter and waive its lien rights in exchange for $16,910.
