No Owner Warranty Of Approved Manufacturer Suppliers; Warranty-implied

A Pennsylvania court has ruled that a project owner's designation of an approved manufacturer did not impliedly warrant that the manufacturer could perform in a timely or adequate fashion.

The Pennsylvania State System of Higher Education awarded a contract to A. G. Cullen Construction, Inc. for renovation of an administration building at the Indiana University of Pennsylvania campus. A major aspect of the work was the replacement of 550 wood-framed windows in the historic structure.
