Bidder Nonresponsibility Determination Upheld Bids-responsibility

A Wisconsin court has allowed a municipality to escape unscathed despite the mishandling of the bidder responsibility determination process.

The Town of Pittsfield solicited bids for four separate road improvement projects. D.M.K., Inc. submitted the low bid on each of the four contracts. Town officials and their consulting engineer expressed concern about D.M.K. due to problems they had experienced with the contractor on prior projects.
