Bid Responsive Despite Omitted Subcontractor List Bids-responsiveness

The Georgia Supreme Court has allowed a public project owner to waive a low bidder's failure to include a list of intended subcontractors.

The Board of Education of Columbia County issued an invitation for bids for construction of a new school building. The IFB said a list of all major subcontractors "must be provided."No post-bid opening changes to the list were allowed without the approval of the Board. The IFB also stated that the Board reserved the right to waive "technicalities and informalities...in the best interest of the Board."
