Prompt Payment Act Applied To Single Payment Payment; Attorney Fees

The Missouri Supreme Court has ruled that a state prompt payment statute applied to contracts calling for a single lump-sum payment. A schedule of progress payments is not required.

Obermiller Construction Services, Inc. was the general contractor for construction of two Wal-Mart stores in Fort Scott and Topeka, Kansas. Obermiller subcontracted the sealing of the two parking lots to Vance Brothers, Inc. for a fixed price of $39,467, to be paid upon completion of the work. The subcontract was governed by the law of the state of Missouri.
