Notice Requirements Varied With Type Of Claim Notice; Claims Administration

The Oklahoma Supreme Court has ruled that standard state specifications contained different notice requirements which applied to different types of claims. A single notice did not preserve all claims.

The Oklahoma Transportation Authority awarded a contract to M. J. Lee Construction Co. for bridge construction in the Tulsa area. Work was significantly delayed due to the failure of a separate lead contractor to complete its assignment in a timely manner. Lee submitted a formal claim for $655,040 in delay damages.
