Bid Responsive Despite Missing Subcontractor Information Bids-responsiveness; Subcontractors

A California court has ruled that a bidder's failure to complete a Small Business Enterprise (SBE) subcontracting form did not render the bid nonresponsive.

The Los Angeles Unified School District solicited bids for construction of a new middle school. In accordance with the state Public Contract Code, bidders were required to complete and submit form 00440, an SBE subcontracting plan.
