Approval Of Substitute Did Not Delay Project Delay; Plans And Specifications

A federal appeals court has ruled that government indecision regarding a proposed substitute product did not delay a contractor's completion of the work.

The Army awarded a contract to AST Anlagen-und Sanierungstecknik GmbH to renovate family housing units at an Army base in Mainz, Germany. The specifications for the insulation system had been based upon a product manufactured by Firm Heck. AST proposed, after contract award, to use a different product, Pumagro, which it represented to be equal to the Heck product.
