Construction Manager May Be Agent Of Owner Multiple Prime Contracts; Payment

The Mississippi Supreme Court has ruled that unpaid trade contractors could recover directly from a project owner if they could show that the construction manager was an agent of the owner and not a general contractor.

John Hancock Mutual Life Insurance Co. planned to renovate a shopping mall it owned. John Hancock entered into an agreement with McMo, Inc., who was referred to as the "construction manager" hired to provide "design, construction documentation and project management services."
