Pricing Information Ruled Trade Secret Suppliers

A North Carolina court has ruled that customer information, pricing structures and fleet mix were all proprietary trade secrets of a construction equipment leasing company.

The president and vice president of BPS Equipment Rental and Sales learned that the company was going to be purchased by Sunbelt Rentals, Inc. Before the acquisition was completed, the executives resigned from BPS and assumed top management positions with Head & Engquist Equipment, LLC, doing business as H & E Hi-Lift. All the companies involved compete in the business of leasing aerial work platforms to construction contractors.
