Board Will Not Duplicate Pending Litigation Claims Administration

The Armed Services Board of Contract Appeals has ruled that it would not consider claim appeals that involved facts and issues common with a pending False Claims Act suit in federal court.

Government Business Services Group, LLC appealed a contracting officer's denial of several claims under a federal contract. A "whistleblower" subsequently initiated a qui tam action against the GBSG under the False Claims Act, 31 U.S.C. sec. 3729, et seq. The U.S. Department of Justice intervened in the action against GBSG.
