"Responsible Bidder" Status Is Not Protected Property Bids-responsibility

A federal appeals court has ruled that a disappointed bidder had no constitutionally protected property interest in an announced contract award or a "responsible bidder" status.

The Puerto Rico Public Housing Authority announced award of a contract to Celta Construction Co. for renovation of a housing project in Ponce. The project was funded by the U.S. Department of Housing and Urban Development.

The Housing Authority later informed Celta that it was rescinding the contract award because Celta had been determined to be a nonresponsible bidder. The Authority said Celta's principal, Miguel Re [...]
