Claims Board Not Limited By Appropriations Claims Administration

A Pennsylvania court has refused to prevent the state Board of Claims from making awards which exceeded the available balance of funds appropriated for the project.

The Pennsylvania Department of General Services awarded 23 construction contracts associated with the development of a 1,000-cell prison facility in Forest County. The Pennsylvania General Assembly had appropriated $139,955,759 for the project.

At the conclusion of the project, seven construction contractors had claims against the Department pending before the Pennsylvania Board of Claims. The claims totaled $1 [...]
