Implied Warranty Extended To Subsequent Purchasers Warranty-implied; Workmanship

The Nebraska Supreme Court has extended the implied warranty of workmanship on a new house to subsequent purchasers of the house.

The McNeil Company, Inc. contracted with the Fahey family to design and construct a new house in Omaha. Construction was completed in 1997. The Faheys sold the house to the Moglia family in 2001.

The Moglias alleged that in 2002 they discovered defective design and construction in the roof system and the drainage system of the house. The Moglias sued McNeil Company, along with the roofing and drainage subcontractors, for breach of the implied warra [...]
