Florida Restricts Eichleay Recovery Delay-damages; Overhead

A Florida court has adopted the new, more restrictive federal rule regarding the recovery of unabsorbed home office overhead in accordance with the Eichleay formula.

Broward County awarded a contract to Brooks Builders, Inc. to construct a fire station adjacent to an active runway at the Fort Lauderdale airport. The project was scheduled to be completed in October 2001. The events of September 11, 2001, caused site access problems that hindered and delayed the work. Substantial completion was achieved in July 2002.
