Unlicensed Sub Recovers For Unjust Enrichment Licenses; Payment

The Idaho Supreme Court has ruled that a subcontract with an unlicensed sub was illegal and unenforceable. But the subcontractor was allowed to recover for unjust enrichment.

Pacific West Construction, Inc. was the prime contractor for construction of an addition to the Bannock Regional Medical Center. The project was subject to the Idaho Public Woks Contractors License Act, I.C. sec. 54- 1901 et seq. That statute applies, with certain exceptions, to subcontractors as well as prime contractors.
