No Pattern Required For Waiver Of Change Order Changes-directed; Waiver

A Kansas court has ruled that a project owner's negotiation of a price for extra work, followed by an oral directive to perform the work, waived the requirement for written change orders. A pattern of disregarding written authorization was not necessary.

Saddlewood Downs LLC awarded a contract to Holland Corporation for construction of the street system in a residential subdivision in Olathe. The contract required written authorization of the project owner for any changes in the scope of work. Over the course of the project Saddlewood issued three written change orders authorizing extra work.
