Waiver Of Neutral Site Ruled Unenforceable Claims Administration

A California court has refused to enforce a clause in a public works construction contract waiving the contractor's right to remove an action to a neutral county.

Contra Costa County awarded a contract to Arntz Builders to construct an addition to the County's juvenile hall. One clause in the contract stated that any litigation relating to the work would be heard in Contra Costa County Superior Court. The clause went on to say that Arntz, based in Marin County, waived its right to removal under California Code of Civil Procedure Section 394.
