Misinformation Waived Insurance Requirement Insurance; Waiver

A federal appeals court has ruled that a prime contractor waived the requirement to be an additional named insured party on a subcontractor's policy by furnishing inaccurate information to the sub's agent.

The City of Houston, Texas, awarded a contract to a joint venture formed by J. F. Shea Company, Inc. and L. J. Keefe Company for a sewer construction project. Shea owned 80 percent of the venture and was the managing partner, responsible for administering subcontracts.
