Sub Denied Recovery Against Engineer And Inspector Plans And Specifications; Negligence

The Colorado Supreme Court has refused to allow a subcontractor to recover in negligence from the project owner's design engineer and inspector.

The City of Denver planned to construct two steel bridges over the Platte River. The City retained BRW, Inc. to prepare the drawings and specifications. The City then awarded the prime contract to Edward Kraemer & Sons, Inc. The City also retained Professional Service Industries, Inc. (PSI) to inspect all the construction work for compliance with the design requirements.
