Board Defines "Unusually Severe Weather" Delay-excusable; Weather

The Armed Services Board of Contract Appeals has ruled that for purposes of excusable delay, the term "unusually severe weather" includes both an unusual number of days of severe weather at the work site or unusually severe weather conditions during a particular period of time.

The issue arose as one element of multi-faceted litigation involving the construction of a hazardous waste storage facility in Colts Neck, New Jersey. All-State Construction, Inc. performed the work under contract with the U.S. Navy.
