Government Did Not Accelerate Work Schedule Acceleration; Schedule

A federal appeals court has ruled that a government letter urging adherence to the schedule, and general expressions of concern regarding the progress of the work, did not constitute a constructive notice to accelerate the pace of the work.

The Army Corps of Engineers awarded a contract to Fraser Construction Co. to dredge a shallow reservoir located along the Zumbro River in Rochester, Minnesota. The water level in the lake was drawn down before the project began. Fraser was required to divert the remaining water flow with a trench and a dike.
