No Board Jurisdiction For Surety's Claim Claims Administration

A federal court has ruled that a board of contract appeals had no jurisdiction to hear a takeover surety's appeal of a matter that occurred prior to execution of the takeover agreement.

The Air Force awarded a contract to Castle Abatement Corp. for renovation of three buildings at McGuire Air Force Base in New Jersey. Castle encountered financial problems and sought the assistance of its performance surety, United Pacific Insurance Co. Castle asked the contracting officer to make all future progress payments to United. Nonetheless, the contracting officer made an additional payment of $116,000 to Castle.
