Slow Response Did Not Divest Contracting Officer Claims Administration

The Armed Services Board of Contract Appeals has ruled that a contracting officer (CO) was not divested of authority to issue a final decision when he waited 18 months to do so. The contractor should have treated the delay as a deemed denial or petitioned the Board for an order directing a decision.
