No Pre-bid Quotation Required From Named Sub Bids-responsiveness; Subcontractors

A New Jersey court has ruled that a public works bid was responsive even though the bidder failed to obtain a pre-bid price quotation from a named subcontractor.

The Township of Monroe Utilities Authority solicited bids for repairs to a pump station. Municipal Maintenance Co., Inc. (MMC) submitted the low bid. The second low bidder, Clyde N. Lattimer & Sons Construction Co., Inc., protested that the bid of MMC was nonresponsive because it violated the state anti-bid shopping statute.
